Ethics & Transparency are Key to Government Responsibility

It seems as if the State of Michigan and local governments in the state will be seeing major ethics reform coming by way of legislation. The ethics reform legislations should make Michigan’s government as well as local governments in the state more transparent than it has ever been. Attorney General Mike Cox is spearheading legislation that would for the first time require Michigan’s top elected officials and their immediate family members to disclose their finances, gifts from lobbyists and potential conflicts of interest. Cox said Michigan rates last among states in its financial disclosure laws by the Center for Public Integrity, which he said gives the appearance of lax ethics in government. “I’m tired of Michigan being last economically. I’m tired of Michigan being last ethically,” said Cox at a Lansing press conference. He also spoke of the proposed legislation in Detroit today. Cox said proposed disclosure laws in the Democratic-controlled House do not go far enough. But a leading watchdog of elected officials and money influence said he doubted the Legislature would approve the tough requirements.

“This is an uncomfortable subject for legislators,” said Rich Robinson, executive director of the Michigan Campaign Finance Network. The financial disclosure requirements would affect all state elected officials and Supreme Court justices, state department heads and local elected officials who are paid more than $65,000 a year. That would include the Detroit City Council and Wayne County Commission. Candidates for governor would have to disclose their individual federal tax returns for the three preceding years. State lawmakers would be required to abstain from voting on legislation if it posed a conflict of interest. Cox said a conflict would occur if the legislator would benefit personally from legislation, beyond what others might gain. The affected officials would be required to disclose:
• Personal income and assets
• Connections to businesses, non-profit organizations, labor organizations and
• All gifts and travel reimbursements from individual lobbyists if the total in a year exceeds $250. If less than $250, no disclosure is required.
• Income over $1,000.
• Assets above $2,500 in value
• Asset purchases and sales worth more than $1,000
• Liabilities, including mortgages, above $10,000, and the identity of creditors.
Also, assets of immediate family members would be disclosed, although their names could be withheld.

Reports would be filed with the Secretary of State, who could investigate violations. Failure to file the information could result in a range of penalties, up to four years in jail and a $10,000 for failing to file three or more reports. The financial disclosure bills are sponsored by Rep. Paul Opsommer, R-DeWitt. The conflict of interest bill is sponsored by Sen. Bruce Patterson, R-Canton Township. Cox was joined in his Detroit press conference by Warren Mayor Jim Fouts and Gary Brown, a candidate for Detroit City Council, both of whom spoke in support.

However the legislation is a good effort for state of Michigan to be ethical and for it to be transparent in its dealings with lobbyists. “If Michigan is to restore its reputation as a quality place to live and create jobs, we must send a clear signal that Michigan is a national leader when it comes to government ethics,” said Cox. “We can do that by requiring financial disclosure from our public officials for the first time in Michigan history.”

Cox’s legislation is the first to propose that elected state office holders, directors of state departments, local officials making more than $65,000 per year, and candidates for those offices give an annual reporting of gifts and reimbursements from lobbyists when their aggregate value exceeds $250 per year, per lobbyist. This legislation, sponsored by State Rep. Paul Opsommer of DeWitt, would also require spouses and dependents to report gifts and reimbursements from lobbyists, which current law does not address. Additionally, the proposal requires these officials, candidates and immediate family members to annually report personal financial information for the first time in Michigan history, and in a similar fashion to current requirements for federal office. All reports would be filed with the Secretary of State’s office, which would have powers to investigate possible violations. Failure to file required information could result in a range of charges, with a maximum penalty of four years in jail and/or a $10,000 fine for failing to file three or more reports.

The Center for Public Integrity ranks Michigan dead-last among the 50 states for financial disclosure by its public officials. Only two other states, Vermont and Idaho, currently have no disclosure laws on their books. However, other states have made ethics reform a priority. Louisiana, for example, recently overhauled its ethics laws and shot up from 44th to 1st place nationally. Full rankings can be seen at www.publicintegrity.org. “Michigan is at the bottom of far too many lists,” said Rep. Opsommer. “Of all the challenges we face, increasing governmental transparency should be one of the easiest and quickest things we can do. There is no reason to wait.”

Cox announcement of a bill sponsored by Sen. Bruce Patterson of Canton, which places in statute the guidelines requiring state legislators to abstain from voting when they have a conflict of interest. Current guidelines exist only in legislative rules and differ between the House and Senate. The legislation requires public disclosure of a conflict prior to abstaining, expands the grounds for conflicts to include business associates and calls for the legislature to create rules to enforce the law. “Full disclosure of all pertinent and relevant information is essential in good government. Information is power and the more information in the hands of each and every one of us, the more informed decisions we can make,” said Sen. Patterson. “With the passing of the full disclosure legislation, pertinent information will be available to everyone.”

Warren Mayor Fouts said, “I applaud Mike Cox for his efforts to initiate this important government ethics proposal.” “I have been a strong proponent of ethics reforms for a long time. It is clear to me that the people of Warren and the State of Michigan have high expectations for their public officials and the Attorney General’s ethics proposal is another step in the right direction.” Under the proposed legislation the Detroit City Council would be required to file financial disclosure reports. “This proposed legislation would be a good template for setting the standard on a local level,” said Brown. “Whether you live in the City of Detroit or anywhere else in the State of Michigan, all citizens want good government.” Attorney General Cox is Michigan’s leading advocate for a more transparent government. Cox has pushed for all state spending to be placed in a searchable online database so that taxpayers can see how their money is being spent. In 2008, he was the first statewide official to place his department’s finances online, where citizens can learn about spending, contracts, travel, and office expenses (www.michigan.gov/trackyourtaxes). Cox also was the first Michigan Attorney General to place legal settlement documentation online, where citizens can review over 7,000 pages of legal documentation (www.michigan.gov/settlementcenter).

Still the ethics reform and full transparency won’t affect many local governments in the state but all elected officials should have to disclose their finances no matter how much the elected official makes. True ethics reform and transparency in government requires all to play by the same rules and that is why if the state of Michigan is to have real transparency and ethics reform in the state than all elected officials should have to follow the same rules no matter how much they make. Nonetheless, the state of Michigan needs real transparency in state government and local governments no if’s, in’s or but’s about it. Ethics and transparency are key to government being more responsible and if that is to happen, we need to make sure that the legislation doesn’t exclude any political officials from disclosing their finances. This is the only way we can clean up government in the state by making sure all political officials disclose this finances and any gifts they receive from lobbyists as well as exempting political officials from voting on issues that could be a conflict of interest. This is the reality that we face and why ethics and transparency will be vital to Michigan’s state and local governments being more responsible and responsive to us the residents of the state of Michigan. Now is the time to do it and our state needs real ethics in order to make sure elected officials throughout the state are doing what is best in the interest of us the people rather than their own self interest.

DuBois, the Black Panther Party, SNCC, or any other activists but we are the fathers, mothers, sons, daughters, uncles, aunties, and relatives of those who came before us to pave the way for us to FIGHT THE POWER! We are not next Generation of leaders who will not be honored and praised until they die but that’s the fight we accept. We are not fighting the power for glory or fame but we are fighting the power for just causes that most men and women will not understand until years or decades later.


We are fighting for our sisters and brothers in Darfur, Georgia, Iraq, Iran, China and Mexico. We are speaking for those who are poor and have no food or water. We are fighting for those who are sick and dying. We are fighting for universal healthcare across the world and human rights for all people. We are fighting for rich and poor! We must FIGHT THE POWER no matter how hard and tough the road may be. We must FIGHT THE POWER for a better today and an even greater tomorrow!
